Terms and Conditions for Tree Surgeons Wanstead
These Terms and Conditions set out the basis on which tree surgery services are provided by Tree Surgeons Wanstead and apply to all customers who request, accept, or receive work from us. By making a booking, confirming a quotation, or allowing our team to start work, you agree to these terms. They are designed to protect both the customer and the contractor by explaining how the service is arranged, what is included, and what responsibilities each party has before, during, and after the work.
Throughout these Terms, references to “we,” “us,” or “our” mean the provider of the tree surgery service, and references to “you” or “the customer” mean the person requesting the work or the person legally responsible for the property where the work is to be carried out. These terms may apply to residential, commercial, and managed premises, unless a separate written agreement has been made.
All work is carried out in accordance with the details agreed in the quotation or written confirmation. Where additional tasks are required, or conditions differ materially from those described at the time of booking, we may revise the scope, timing, or price of the work. Any such changes will normally be discussed before further work proceeds, except where urgent action is needed to avoid damage or danger.
Booking Process
Bookings may be made following an initial enquiry and, where appropriate, a site visit, inspection, or request for photographs and measurements. A booking is not confirmed until we have accepted the job and, where required, received any deposit or written approval requested in the quotation. The booking process may include a discussion of the tree work required, access arrangements, waste removal, equipment needs, and any permissions that may be necessary before work can lawfully begin.
Customers must provide accurate and complete information when booking, including the location of the trees, the type of work required, access limitations, known hazards, and any relevant property restrictions. If information is incorrect or incomplete and this affects the planning, cost, or completion of the work, we reserve the right to adjust the quotation or reschedule the appointment. We may also refuse to proceed if the site is unsafe or if the work requested is outside our competence, insurance cover, or legal permissions.
Any date or time given for attendance is an estimate unless expressly stated otherwise. Tree surgery often depends on weather conditions, traffic, site access, and the safe use of machinery and climbing equipment. We will always aim to arrive within the arranged time window, but delays may occur. If we need to change the appointment for safety or operational reasons, we will make reasonable efforts to notify you as soon as possible and propose a new date.
Payments
Unless otherwise agreed in writing, payment is due in accordance with the quotation or invoice issued for the relevant service. We may require a deposit, part payment in advance, or full payment before commencing certain types of work, particularly where specialist equipment, waste processing, or subcontracted services are involved. Payment terms will be stated clearly before work begins wherever practicable.
All prices quoted are based on the information available at the time of quotation and may be subject to change if the scope of work changes, hidden hazards are discovered, or access conditions are materially different from those described. Where an estimate is provided rather than a fixed price, the final amount may vary depending on time spent, materials used, and disposal charges. Additional work will not normally be undertaken without your approval, except where it is necessary to protect life, property, or prevent immediate damage.
Invoices must be paid in full by the deadline shown on the invoice, unless a different arrangement has been agreed in writing. We accept no responsibility for delays in payment caused by bank processing, third-party finance providers, or incorrect payment references supplied by the customer. If an invoice remains unpaid after the due date, we may charge reasonable recovery costs and interest where permitted by law. We also reserve the right to suspend further work, withhold completion documentation, or refuse future services until all outstanding sums have been settled.
Cancellations and Changes
You may cancel or reschedule a booking by giving us reasonable notice. If notice is given sufficiently in advance and no materials, labour, or disposal costs have been incurred, any deposit may be refunded at our discretion or transferred to a new date. Where a cancellation is made after we have committed staff, machinery, or waste processing resources, we may retain part or all of the deposit to cover our loss.
Cancellation charges may apply if we attend the site and are unable to carry out the work because access is blocked, permissions have not been obtained, the customer is not present where attendance is required, or the tree work cannot safely proceed for reasons attributable to the customer. In such cases, we may charge for time spent, travel, and any preparatory costs reasonably incurred. If weather or safety conditions prevent us from working, we will normally offer an alternative date rather than charge cancellation fees.
We may cancel or postpone work at any time if there is a reasonable concern about safety, legal compliance, severe weather, equipment failure, or circumstances beyond our control. If we cancel for reasons within our control, we will endeavour to rearrange the work or refund any advance payment for work not yet performed. We are not responsible for indirect losses arising from cancellation or delay, such as lost business time, alternative contractor costs, or inconvenience, unless required by law.
Liability and Customer Responsibilities
We will carry out tree surgery with reasonable care and skill, using competent personnel and appropriate equipment. However, tree work is inherently hazardous and can involve unpredictable natural conditions, concealed defects, changing weather, and risks associated with timber, roots, branches, and nearby structures. While we take precautions to reduce those risks, some outcomes cannot be fully controlled.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded under UK law. Subject to that, we are not liable for loss or damage caused by pre-existing defects, hidden decay, structural weakness, unstable ground, or other conditions that were not reasonably discoverable before work began. We are also not liable for damage arising from the customer’s failure to disclose relevant information, obtain permissions, or secure vulnerable items or property.
The customer is responsible for ensuring that we have clear and safe access to the work area, including access for vehicles, machinery, and removal of waste where relevant. You must notify us of underground services, overhead lines, irrigation systems, drainage runs, shared boundaries, protected trees, or any other feature that may affect the work. You should also remove or protect items that may be damaged by falling branches, sawdust, or debris unless we have specifically agreed to do so as part of the job.
Waste Regulations and Site Clean-Up
All green waste, timber, brash, stump material, and other arisings are handled in accordance with applicable waste legislation and best practice. Unless otherwise agreed, any waste produced by the work remains our responsibility once removed from the site and will be transported, stored, treated, or disposed of through lawful and authorised channels. We may segregate waste for recycling, composting, chipping, timber recovery, or disposal depending on the nature of the material and the facilities available.
Where the quotation includes waste removal, this will normally cover standard arboricultural waste generated by the agreed works. It may not include unexpected quantities of material, contaminated waste, soil, hardcore, invasive species waste requiring special treatment, or items unrelated to the tree surgery itself. If such material is discovered, we may need to revise the price or arrange separate disposal. The customer must not ask us to leave waste on public land, neighbouring property, or anywhere that would breach environmental or local authority rules.
We aim to leave the site tidy and safe after completion of the work, but some residual debris such as sawdust, fine twigs, leaf litter, or marks on lawns and hardstanding may remain after normal operations. Where stump grinding or heavy machinery is used, ground disturbance may occur and light restoration may be necessary. Unless specifically included in the quotation, re-turfing, replanting, and landscaping repairs are not part of the standard service.
Permits, Permissions, and Legal Compliance
The customer is responsible for confirming whether planning restrictions, tree preservation controls, leasehold consents, landlord permissions, conservation obligations, or other approvals are required before work starts. If we are asked to proceed without the necessary permissions, we may refuse to do the work or suspend it until the position is resolved. Any delay or additional cost caused by missing permissions will be the customer’s responsibility unless we have expressly agreed in writing to obtain them on your behalf.
We will comply with applicable health and safety law, environmental obligations, and professional standards relevant to the services provided. Our team may use climbing methods, chainsaws, ladders, lifts, chippers, and other equipment appropriate to the task. You agree not to interfere with equipment, instruct staff to operate unsafely, or direct us to take action that would breach legal or technical requirements. We may stop work immediately if compliance concerns arise.
Nothing in these Terms affects your statutory rights as a consumer where those rights apply. If any term is found to be unlawful, invalid, or unenforceable, the remaining terms will continue in full force to the extent permitted by law. Any failure by us to enforce a term on one occasion does not mean that term is waived for future bookings or future breaches.
Warranty, Aftercare, and Completion
Because trees are living organisms, no guarantee can be given that a tree will respond in a particular way to pruning, reduction, felling, or stump treatment. We do not warrant future growth, flowering, fruiting, stability, or regrowth patterns unless a specific written warranty has been agreed. Advice given by our team is based on the information available at the time and should not be treated as a guarantee of outcome.
Work will be considered complete when the agreed tasks have been carried out to a reasonable professional standard and the site has been left in a condition consistent with the quotation. Minor adjustments may be necessary where access, weather, or tree condition change during the job. If you believe any element of the work has not been completed as agreed, you must notify us within a reasonable time so the matter can be reviewed. This does not extend the payment deadline unless we confirm otherwise in writing.
If we discover during the job that a tree presents a materially greater risk than expected, or that the work is more extensive than quoted because of hidden decay or structural issues, we may recommend further works, postponement, or alternative treatment. Any additional proposal will be explained before it proceeds wherever possible. Our priority is to deliver safe and lawful tree surgery services rather than to force completion where conditions make the original plan unsuitable.
Insurance and Indemnity
We maintain insurance cover that is appropriate for the services we offer, subject to the terms, exclusions, and limits of the relevant policy. Copies or evidence of cover may be made available on request where appropriate. You acknowledge that no insurance policy can cover every possible contingency and that some risks are outside our control, especially where site conditions are poor, information is incomplete, or the customer has not taken reasonable care.
You agree to indemnify us against losses, claims, costs, or liabilities arising from inaccurate information supplied by you, unlawful instructions, failure to secure permissions, or interference by the customer or third parties under your control. This includes claims connected with access issues, concealed services, or items left in the work area contrary to our instructions. This indemnity does not apply to losses caused by our own negligence or breach of these Terms where liability cannot be excluded.
If any dispute arises concerning damage, workmanship, pricing, or scope of service, both parties should act reasonably and attempt to resolve the matter promptly. You should keep photographic evidence where relevant and notify us as soon as practical so the site condition can be reviewed. Delayed notification may make investigation more difficult and may affect any assessment of responsibility.
Governing Law
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where consumer law gives you the right to bring proceedings in another competent court.
By engaging Tree Surgeons Wanstead, you confirm that you have read, understood, and agreed to these Terms and Conditions. They form the legal framework for our tree surgeon services, tree maintenance works, and associated waste handling arrangements. If you require clarification before booking, you should raise it before the work is accepted so that both sides are clear on the scope and expectations.
These Terms may be updated from time to time. The version in force at the time of booking will generally apply to that booking unless a newer version has been agreed in writing.
